ATF to Criminalize Gun Owners with Pistol Brace Rule

U.S.A. — The ATF, an organization that has no right to create laws, is giving you until the end of the month to either destroy, register or turn in your pistol brace. Those who choose neither of these options could face 10 years in jail, a $10,000 fine, or both. The new rule that went into effect on January 31, 2023, is becoming a reality in a few short days. Pistol brace owners were given 120 days to comply.

At no time in our history have pistol braces or stabilizers ever been restricted or required to be registered. However, the ATF under the Biden Administration believes that they can now circumvent Congress and write new rules that will turn 40 million gun owners into felons on June 1, 2023. This is achieved by simply re-classifying any firearm with a pistol brace as a short barreled rifle (SBR), making it subject to registration under the National Firearms Act (NFA) of 1934.

This new ATF rule is not a law, nor does it meet historical tradition, yet it instantly turns law-abiding citizens into felons overnight despite the fact that our history shows us pistol braces and detachable stocks being used as far back as the early 1700s. Somehow, 300 years later, these devices have become a threat to society according to the gun grabbers at the ATF and those encouraging this reckless behavior.

Because the ATF has no business making laws that turn good people into felons, during the Biden administration, they seem to have chosen the path of simply changing the rules.

The ATF’s new rules are outlined as follows:

  • Submit through the eForms system an Application to Make and Register a Firearm, ATF Form 1 (E-Form 1) before May 31, 2023.
  • Permanently remove or alter the “stabilizing brace” so that it cannot be reattached and thereby removing it from regulation as a “firearm” under the NFA.
  • Remove the short barrel and attach a 16-inch or longer rifled barrel to the firearm thus removing it from the provisions of the NFA.
  • Turn the firearm into your local ATF office.

In 2012, the ATF recognized pistol braces as a legitimate device when used in conjunction with a pistol. Have these devices suddenly become dangerous to society or is the ATF, under the Biden Administration, looking for a new way to create a de facto registration for gun owners?

On March 20, 2023, Representative Richard Hudson sent out a press release announcing a congressional review act (CRA) on the matter.

“U.S. Representative Richard Hudson (R-NC), Rep. Andrew Clyde (GA-09), and 180 House Republicans introduced a Congressional Review Act (CRA) resolution to prevent the Biden Administration’s Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) from enforcing an unconstitutional pistol brace rule. Sens. John Kennedy (R-LA) and Roger Marshall (R-KS) introduced the companion resolution in the Senate. “This rule is a blatant overreach by the ATF and jeopardizes the rights of law-abiding gun owners, including disabled veterans across the country,” said Rep. Hudson.

Several lawsuits have been filed against the rule and the Firearms Policy Coalition is one organization that is seeking an injunction.
