Zoning-Away Your Gun Rights – The Legal Brief ~ VIDEO
USA – -(AmmoLand.com)- Welcome back to The Legal Brief, the show where we CRUSH the various legal myths and misinformation surrounding various areas of the gun world. I'm your host Adam Kraut and today we're talking about a Pennsylvania Township's attack on a gun range that's been there for over 50 years.
While most of the cases we discuss involve a law being passed to prohibit the exercise of the right to keep and bear arms, I think this may be the first time we discussed it from a zoning context. Local governments are typically in charge of dictating the zoning of particular area of land within its borders. In this case, we are talking about a gun range that has been operating for the better part of a century and how the township is trying to put a stop to it.
Our plaintiffs in this case, William Drummond, his LLC and the Second Amendment Foundation are suing Robinson Township, which is just west of Pittsburgh, and its zoning officer, alleging that the township was violating Drummond's Second and Fourteenth Amendment Rights.
A quick backstory on the property is in order. Drummond's grandfather began to operate a range on the property in 1967. According to the complaint it “consisted of a clubhouse and restaurant, as well as the living quarters of its manager and the manager's family, four trap ranges, three skeet ranges, a 25-yard pistol range, a 100-yard rifle sighting range, and a 400-yard rifle range.”
In 1972, Drummond's grandfather passed and left the property to his wife, who in 1990, sold the property to Drummond's uncle while retaining ownership of the club itself. In 2008, Drummond's uncle became a prohibited person and the gun club operations ceased, until 8 years later in 2016, when a company, Iron City, leased the property through the end of 2017. That's when Drummond leased the property from his uncle and this current fiasco began.
You see, prior to this current lawsuit, the Township had tried two separate times to shut the club down. The first attempt came in 1993, when the Township brought a nuisance action against the club. In that lawsuit “the Township admitted that the Gun Club was lawfully operating its business under the Township's zoning ordinance…however, it complained about three matters: the discharge of automatic weapons, which would cease the following year; the club's hours of operation; and projectiles leaving the premises and striking nearby properties,” which the Court found not to be true. The case only took 4 years, but in 1997, the court found in favor of the gun club.
In 2016, while Iron City was operating the club, the Township tried to shut it down again. Iron City had been authorized to operate the property as a club for its members, with a condition that no other commercial operations are allowed on site, including but not limited to sales, gun testing, rentals, or other commercial endeavors. It also prohibited activities related to any Federal Firearms License at the club. In June and July of that year, the Township served Iron City with two cease and desists notices, followed by a decision to revoke its permit based on complaints that the club was selling water, targets and ammunition. An undercover police operation had confirmed that the club sold targets and ammo. Iron City appealed to the Court of Common Pleas and prevailed. Which brings us to the current legal fight.
In January, Drummond spoke to the Zoning Officer for Robinson Township advising him of his intentions to continue the club's operation, and asked what was required of him to take over the Club's operation and remodel. Dorsey, the zoning officer, told Drummond to write him a detailed description of his plans, which he did, and then Dorsey disappeared. He never responded to Drummond's letter or numerous follow-up phone calls.
In February of this year, unbeknownst to Drummond, someone involved in the prior nuisance suit requested expedited action on restrictive zoning amendments targeting the Gun Club at a Township meeting. Two days later, the zoning officer told Drummond he would have to file a zoning application but that it need not be done immediately. A week after that prior meeting, the Township held a Special Meeting for the apparent purpose of considering restrictive zoning to halt the Gun Club's operation. No one advised Drummond that this meeting was being held and yes…the zoning officer attended.
It was not until a few weeks later in mid-March before Drummond was able to meet with the township zoning officer to discuss the plans for the range. He was told to complete the zoning application, which he did, but was never informed of the pending zoning change. A few days later Drummond learned of another special meeting, which he ended up attending and the Township tabled its effort to rezone the property. Unfortunately for him, the Township ultimately adopted amendments to the zoning ordinance in early April, prior to rejecting his application which had been in their possession for over 30 days.
The amendments included, among other things, defining the term “Sportsman's Clubs” to mean a “nonprofit entity formed for conservation of wildlife or game, and to provide members with opportunities for hunting, fishing or shooting” and regulating the clubs to only allow “pistol ranges, skeet shooting, trap and skeet, and rim-fire rifles.” Yup, no centerfire. And that brings us to today.
The lawsuit alleges that restricting the operation of so-called “Sportsman's Clubs” to non-profit entities along with a blanket prohibition on the use of center-fire rifles, without sufficient regard to their suitability at a particular location, infringes on the right to keep and bear arms. It further argues that by treating “Sportsman's Clubs” differently from other businesses, solely on account of activity secured by the Second Amendment, the Township Zoning Ordinance violates the right to equal protection in the exercise of a fundamental right. The suit also claims that the defendants deprived Drummond of his property interest by frustrating and delaying his application to operate the Gun Club, all while they pulled a bait and switch to deny his application. And for good measure, the suit claims that right to pursue a livelihood is a privilege or immunity of federal citizenship that cannot be abridged by state actors under the Fourteenth Amendment, which is exactly what the Township is doing.
Drummond is seeking a permanent injunction against Robinson Township from the enforcement of its new zoning ordinance along with an order commanding the Defendants to issue him all the required permits to operate the club. And like any good lawsuit, he wants attorneys fees. It appears, based on the Defendant's actions, particularly the fact that they knew Drummond was submitting a zoning application but failed to advise him of their plan, that the Township may be in for another smackdown from the courts. Of course, as with any litigation, we have no idea how this will pan out.

Our liberal “mainstream” media, corruptly motivated only by grievance and identity politics, have piously declared that reports on recurring, fatal attacks on South African farmers by ANC-sponsored thugs (their version of ANTIFA) are all untrue!
They point out that such barbarous attacks are reported mostly through Afrikaner agricultural organizations, and otherwise only mentioned (inappropriately) by our “misinformed President.”
These are the same voices who naively denied reports of generalized persecution (murder) of Jews in Nazi Germany in the 1930s. They self-righteously assured us that the ongoing Holocaust was/is all in our imaginations.
Many still do!
Media in RSA(Republic of South Africa), like that in Nazi Germany, are intimidated into downplaying farm attacks. With a few exceptions, liberal media over here won’t report them either, because of their perceived obligation to defend Marxists no matter where they are, and no matter what they do.
Armed (at least for now), private security response-teams always arrive at sites of farm-attacks hours before RSA Police. They see the hideous carnage firsthand! When RSA Police respond at all, it is seldom within twenty-four hours of the first, desperate call!
Marxists, since 1917, have never hesitated to use lethal violence to intimidate critics and political opponents.
Over here, we see black-clad ANTIFA thugs, enjoying the (barely) covert support of the DNC, being likewise slowly transformed into politically-approved, arcanum enforcers of the leftist ethos, as across the nation, old-guard Democrat elected officials (who had at least a modicum of personal dignity) are being swept from office by openly-socialist/Marxist, self-proclaimed “revolutionaries.”
Some such “modern Democrats” (Maxine Waters, et al) are even now, unapologetically calling for open violence against political opponents.
As the Democrat Party continues its relentless march toward Marxism, most professing “liberals” will blindly follow, and ANTIFA will be only too happy to carry out their violent agenda- first secretly, then openly.
Will we see RSA-style “farm murders,” based on ethnic and political profile, break-out in rural areas within CONUS?
When it happens, you can bet our corrupt media will never report it. And, when such stories can’t be suppressed, our media will predictably jump to the defense of Marxist thugs.
Between now and then, cunning crypto-Marxists (masquerading as “progressives” and “liberals”) will continue to work relentlessly to disarm their future victims, much as they’re doing in RSA, much as they did in Russia in 1917 and in Nazi Germany in the 1930s.
They mean to “rule!”

Fairfax, VA – -(Ammoland.com)- The National Rifle Association Institute for Legislative Action (NRA-ILA) today launched a six-figure TV ad campaign highlighting that Sen. Jon Tester cannot be trusted to support the rights of Montana's law-abiding gun owners. The ad will air statewide on cable and broadcast television.
“Contrary to what Jon Tester says in Montana, he has supported the gun control agenda of Nancy Pelosi and Chuck Schumer by voting in favor of gun control in Washington, D.C,” said Chris W. Cox, executive director, NRA-ILA.
Tester has supported criminalizing the private transfer of firearms between lifelong friends and some family members, which the Obama justice department said could only be enforced through federal gun registration. Tester voted with Chuck Schumer and the anti-gun liberal left to confirm anti-gun Justices Elena Kagan and Sonia Sotomayor to the U.S. Supreme Court. He also voted against the confirmation of Neil Gorsuch, a pro-Second Amendment justice, to the U.S. Supreme Court.
“Montana gun owners deserve a trustworthy, consistent advocate for their Second Amendment freedoms,” continued Cox. “Jon Tester cannot be trusted to stand with President Trump and support our fundamental right to self-defense.”

California Pushing 8 New Gun Control Laws – The Legal Brief ~ VIDEO
USA – -(AmmoLand.com)- Welcome back to The Legal Brief, the show where we CRUSH the various legal myths and misinformation surrounding various areas of the gun world. I'm your host Adam Kraut and today we're talking about how California is back at it again with another round of gun control laws. Yea I know.
Recently, eight, that's right EIGHT, different bills were advanced by committees in California and after the recent tragedy in Florida, two of them are now on their way to the Governor for signature. Now, I know what you're thinking, But Adam, doesn't California already have a billion different laws about guns already? Yea, California has a large number of laws on the books. But apparently, at least according to their politicians, not enough.
We're going to explain all 8 of these, one by one. Since they didn't all have names, we here at TGC put our heads together and created our own.
First up, AB 1968 the It's Ok to Be Crazy Once, Crazy Twice Lose Your Rights Act. This one would create a lifetime prohibition on anyone who has been taken into custody, assessed, and admitted to a designated facility because he or she is a danger to himself, herself, or others, as a result of a mental health disorder two or more times in any one year period. If this bill were to be signed into law and a person would find themselves back in a facility within a year of previously being there, bye bye firearms rights for life. Now there is a petition process to attempt to get your rights restored, however, if the petition is denied, you have to wait 5 years before you can try again. This bill is currently awaiting review by the Governor.
Assembly Bill 2103, otherwise known as The Minimum Amount of Flair Required Act, would require a minimum of 8 hours of training to receive a concealed carry license in California. And yes, it IS possible to get a concealed carry license in California. Currently, the way the law is written and best I could tell from several sources, including the Los Angeles County Sheriff's Concealed Weapon Licensing Policy, the only requirement with regard to length is that it not exceed 16 hours. So Californians would need to undergo a mandatory number of hours of training in order to obtain a concealed carry license. This bill is also awaiting review by the Governor.
Next up, AB 1927, the Here You Have My Freedom Act, would require the DOJ to study the concept of a “voluntary prohibition list”. Yes, that's right, the California DOJ is going to investigate how you should be able to sign up to give your rights away. The bill requires a report to be submitted to the legislature no later than January 1, 2020. If someone doesn't want to own a gun, couldn't they just, I don't know, not buy one?
Keeping up with the Joneses, AB 2888, The LOL Due Process Act, would implement Gun Violence Restraining Orders. The bill would allow an employer, a coworker, or an employee of a secondary or postsecondary school that the person has attended in the last 6 months to file a petition for an ex parte, one-year, or renewed gun violence restraining order. As we've beaten to death on other episodes bills such as this one are riddled with due process issues, so we won't dive into the weeds on that one. Although, I have to say, I'm surprised California doesn't already have this on the books.
If you're one of the people that enjoys going to gun shows at the Cow Palace, SB 221 otherwise known as The Bulls*** Act, would put an end to that. That's right, the bill would outright prohibit gun shows to occur there. Apparently, that one particular venue contains too much freedom and they want to put a stop to it.
SB 1100, otherwise known as the You Must Be This Tall to Freedom Act, would prohibit the sale or transfer of a firearm by a licensee to anyone under 21 years of age, with a few exemptions. Those include a valid hunting license issued by the state, law enforcement and members of the military. Here we see yet again another state attempting to regulate WHEN a person may exercise their constitutional right to keep and bear arms.
But wait, there's more…SB 1177, the Rationing of Firearms Act, would restrict ANY firearms purchase to one every thirty days, barring a few limited exemptions. Currently, the law restricts purchases of a handgun to one every thirty days. Surely there has to be some argument that this is violative of the Second Amendment, after all, the ability to acquire arms in order to exercise that right must come into play.
Last up is SB 1487, the Toto Act, actually called the Iconic African Species Protection Act. This one would essentially just fall short of making it illegal to hunt in Africa by prohibiting the possession of certain species of animals or their parts. The fine would range from $5,000 to $40,000 for a violation. Animals include the usual suspects, as well as zebras and hyenas. The bill even provides a reward for information which leads to a successful fine imposition.
As you can see California is continuing down the road of finding new ways to add more restrictions to firearms rights. Which begs the question, when is enough going to be enough?

Fairfax, VA – -(Ammoland.com)- The National Rifle Association Political Victory Fund (NRA-PVF) today launched a six-figure TV ad campaign highlighting that Sen. Joe Manchin cannot be trusted to support the rights of West Virginia's law-abiding gun owners.
“Voters deserve the facts before they head to the polls,” said Chris W. Cox, chairman, NRA-PVF. “Contrary to what Joe Manchin says in West Virginia, he has supported the agenda of Barack Obama and Chuck Schumer by voting in favor of gun control in Washington, D.C.”
The TV spot will run in the Charleston and Bluefield markets beginning today, Wednesday, Sept. 5. Manchin has a “D” rating from the NRA. He has supported criminalizing the private transfer of firearms between lifelong friends and some family members, which the Obama justice department said could only be enforced through federal gun registration.
In addition, Manchin has opposed veterans’ Second Amendment rights.
“Make no mistake, Joe Manchin cannot be trusted to vote with President Trump on our fundamental right to self-defense,” Cox concluded.
